What Happened Here?

Most of the time, we can count on knowing when there are faulty products on the market after it is suspected they cause, or could cause, injuries or illnesses. The government website that tracks recalls currently has hundreds of potentially harmful products listed.

In most cases, recalls are issued voluntarily and with the assistance of the FDA or the Consumer Product Safety Commission (CPSC). However, when the CPSC got involved in the case of a Britax stroller that has caused injuries, that is not how the process went.

The CPSC has received reports of hundreds of injuries that have occurred due to the front wheel of the Britax BOB stroller malfunctioning while being used. Both children and parents have sustained injuries, some of them serious. The CPSC investigated and asked Britax to recall the product, which the company refused to do. In January of 2018, the CPSC filed a lawsuit to force a recall, but Britax fought it.

After a leadership change at the CPSC, the lawsuit was dropped and the strollers never faced a recall. They got off with simply having to release a safety video about how to properly use the stroller.

Faulty products are out there and they happen in one of three ways:

  1. They have a bad design, as would appear to be the case with the stroller.
  2. They are damaged in manufacturing, altering them from their original design.
  3. They have labeling problems that mislead or do not properly inform consumers. This can include problems with ingredient lists, dosages, instructions, hazards, and more.
