Sarbanes Oxley whistleblower protection questions

    QUESTION

    I have been retaliated against in the past for reporting fraud within a large IT enviroment and I am fearful of retaliation, I have young children and I really need the job. This has to do with Sarbanes Oxley controls. This has come in a series of unjustified demotions for me. In desperation I did my own background check on the CTO that retaliated against me and took my promotion (this was pre sox around the end of 2002). He has lied on his resume and he does not have a degree in Computer science (which I suspected as he’s pretty clueless). That degree that he has is from a diploma mill (Buxton College, London), you pay $325 and they will send you a degree immediately – no course work involved. For $550 you can even get a phd. This is easily verifiable but since he is no in charge of the IT security departments he can get away with it and make weak people look the other way.

    Since this person is tasked with PCI, SOX 302 and 801 attestations as a CTO of a very large and public company I believe that this is a major problem. Additionally in the process of doing this he has mislead external auditors, board of directors and others in IT internal control matters. Since I have retaliated against in the past I am hesitant on reporting this and it will ruin me as the auditing firms and partners have verified questionable controls over the years. I have tried to tell them but they are more concerned with there fees and its 2 of the big 4. Additionally when I did report this our board had our external auditor KPMG audit of my department and my claims. KPMG sent out somebody that was a fraud themselves as a “management consultant” and then told the board exactly what they wanted to hear. I am still living in hell because of all of the fraud

    Mardoff’s CFO had a bogus degree too - Do I have any recourse? I can prove this a lot better. Could someone answer this question?

    Welcome to the forum, Bubba. I am afraid I have no experience in this area but perhaps OnYourSide does.

    8 Washington State Patrol troopers got caught red-handed buying fake diplomas in order to promote and gain increases in their salaries. Rather than fire them, the State Patrol has decided to slap them on the wrists and gave them from 3-10 days of leave without pay. I have a real problem with this. They INTENTIONALLY bought fake diplomas and they keep their jobs. I give 25 years of my life to the Dept of Social & Health Services and my ex-sup fabricates lies against me and I get fired. Where is the justice in letting State Troopers buy fake diplomas and then keep their jobs? What kind of a message does this send to people??

    I'm not sure I understand what your question is. Is it:

    1) Do you have any recourse against the retaliation you've already suffered as a result of having already previously reported fraud within the company for which you work?

    or is it:

    2) Do you have any recourse against the fake-degreed PTO guy, bringing his misdeeds out into the open?

    Hey Lulu .... couldn't agree with you more - fake training degrees in this case aren't as dangerous as surgeons, nurses, etc. - but still stinks -

    The troopers case probably involves some kind or Union or collective bargaining discipline or arbitration structure /procedure where their violation is considered much lesser on the scale of all the more dangerous (life and death, fatal) violations for which a trooper/ police-type may be terminated on first violation or immediately ...

    just some 2 cents ....

    Why are so many people hired in companies that have fake credentials? one a memeber in this forum is also a victim of a abuse and harassment from a boss who is a Fake, and not only that, he gets to make money from people's loved ones under his care....entrusted under his professional care who has nothing but a fake diploma? I said that because I have a habit of checking on doctor's offices(or etc. profs.) and seeing all those laminated credentials,/diploma gives you a sense of security that you are in good hands.......am i suppose to question that too?!?! Possible fake credentials?! WOW......I do not know what to say ......

    Sleepless, you are right about their being a union (same useless one I had/have) and a collective bargaining agreement. HOWEVER, they knowingly bought these fake diplomas and then used them to receive promotions and raises which is pretty much THEFT. Add the fact that they are *supposed* to be upholding the laws as state troopers. Then I get fired for dating a form or for a few long distance phone calls that I DID make but they didn't appear on my monthly phone logs thanks to errors on the phone company's computer systems?? In other words, I was an honest state worker and I get fired for fabricated issues and these 8 state troopers intentionally do something they KNOW is illegal and they get a slap on the wrist? Obviously the union reps for state troopers are more diligent at defending their dishonest members than MY area reps are..........
