A little victory today !!!!

    Hello everyone,
    I would like to share with you a litlle victory, a little positive thing that today has happened.

    After my employer had told me at the mediation that eaither I would quite my job and I would get unemployment benefit package like other people who was getting leied off at that time or I would get fired, I said I will not resighn my job.
    (the EEOC is still investigating since then )

    So, I got fired. When I had applied for unemployment I was denied by my employer.I appealed. Last week I had a hearing over the phone with judge and my ex employer(manager, Hr director and their lawyer ).

    Today I got a letter stating that I am eligible.

    They still can appeal, but what a victory, judge believed that there was no misconduct. :):):):):):):):):):):

    Wonderful news about the unemployment. Isn't that crazy they were willing to pay the claim if you resigned? Very very crazy.

    Congratulations Temida.

    My unemployment denial appeal hearing is next Friday. I am *scared* even though I know I have a good case to dispute the denial and even the adjudicator apologized to me when she had to deny my UC and advised me what to say to the law judge. After no real income for the past 4 months, I guess I am getting a bit dispondent and apprehensive.........

    I can tell you my heart was pounding like crazy but I put all the paperwork and the exibits that I had submitted to them on the big table so I could have them handy when the judge was asking question or I was reffering to them when I was questioning my ex manager,
    What I would do different?

    Write questions that you want to ask your ex employer (manager or whoever will be on their side).

    Also, it is important !!!!

    At the end the judge let them give a little speach and me. So, get ready with a little short but conviniencing summarizing speach to the judge which will let him know that you are the victim of their wrongdoing and there was no misconduct.

    That is my little advice from my experiance to everybody.

    I just hope that if they appeal the board will find me not quilty as well and I feel for you littlelulu because I have no income since january and I have four children.

    My hearing is also by phone. I will be at my attorneys office, the ALJ (adiminstrative law judge) in Olympia on the phone and then a rep from DSHS - either HR or maybe my ex-administrator. The adjudicator for Employment Security (unemployment office) told me what to have my attorney hit on because she *really* wanted to approve my UC and not cause this delay because she was *shocked* when she heard my side of the story as was her leadworker. She also said it would be helpful to have statements from my former co-workers as to what a good worker I was so they are getting those ready for me to pickup on Wednesday. I am also *hoping* that the ALJ's for these type of hearings are like the ALJ's for when clients file a fair hearing. The ALJ's that deal with those really HATE my former employer and almost always side with the client, even when the clients have a poor defense for themselves.
