Hi folks, first post here so I hope I don't screw anything up. I feel as though my employeer is purposly trying to make me quit, and i'd like some advice. First, the back story. My girlfriend and I recently moved from a large city to a small town to live with my parents several states away. The intention was to aquire jobs left by students leaving for school, and save up money so that we could move to Tucson, our final destination. I got a job at a local convinence store, making $10 an hour, and was promised 40 hours a week, with the possibility of overtime if I was willing to travel to other stores.
I found out after my first pay check that I was hired at $9 an hour, with a $1 an hour 'summer bonus' that ended several weeks after my employment. Also, even after the boss posted several notes saying that another location needed help, and requesting several times (verbaly and through return note) that I get the hours, none where assigned. My best week I was given 36 hours so far. Durring that week I was accidentally an hour late, as the time sheets are hand written. I mistook 2:30 for 3:30. I appologized profusely. Other then that I am a very good employee. Customers seem to like me and my register is always correct. After that incedent I was given 16 hours the next week. When I pulled up out front of the store to get my hours I saw in the window that the manager (same lady) a female employee and a female asst. Manager where all joking and laughing and having a good time. When I walked in they all became very quiet. I was cheerful and said good morning to everyone, no one responded, they all became very ocupied with various tasks. I was handed my paycheck without a word, despite greeting each person by name. I wrote my hours down and said goodbye to the boss, who muttered 'thanks' without looking at me.
I was schedualed that Friday night with a note on the sheet stating that I was to be sent home if it was not busy, as there was a festival in town. I have never heard of an employee being sent home early.
The scheduals are posted on Friday mornings. When I showed up that Friday night the schedual was not posted, instead a note claiming that the schedual would be posted the next morning. There was also a note on my register from the boss that stated another asst. Manager would be taking some time off and that 'all employees schedualed for under 40 hours should expect a heavier shift load while she was gone.' That Friday night turned out to be very busy so I stayed. Also, when I showed up, the asst. Manager on duty had me order 2 new long sleeve work shirts, as everyone was getting them for the winter.
I came in the next day excited that I would be getting more hours. I had been schedualed for three hours for the entire week. And a new female employee had been hired, at 36 hours. I believe that it was my bosses intention to force me into quitting, heck, they'd already hired the replacement. When I showed up for work the next week (all three hours of it..) I was written up for being late two weeks prior.
I spoke with the same asst. Manager who was soon leaving for vacation. I told her about the note about hours, and how the schedual hadn't been posted the night before. She told me that the schedual hadn't been posted because the boss did not want me to quit on a busy night, and that '*name of boss* doesn't fire people.' She gets them to quit. I worked my 3 hours and went home. I went in the next Friday for my schedual and saw that I was once again assigned 3 hours for this week.
This morning I woke up early for work, but when I went to get my shirts, I noticed my dog had urinated on my clean clothes basket(shows me for not putting them away the night before..). I put on a plain t shirt (which is what I wore before I was given shirts. When I showed up for work, I explained the situation to the boss. She told me that I was not allowed to wear a t shirt, and could either wear the urine soaked shirt, or just go home. I asked if I could just have the long sleeved shirts that where orded, as it had been two weeks, and it only takes three days for them to arive. She told me I was not allowed to have the new shirts, as the origionals that where ordered where 'loaners' and the two that I had ordered where to replace them. This is simply not true, for one, EVERYONE ordered new long sleeve shirts (the origionals where short sleeved). Everyone else had already received their long sleeves. When I ordered the shirts, I had to log into the system using my employee number, and was given a prompt explaining that everyone in the company would be receiving complementary long sleeve shirts for the winter.
Further more, the schedual is written from top to bottom, with the top being the boss, followed by asst. Managers, and then employees, in order of when we started working. The new female employee is written above me. I believe this is yet another tactic by the boss to intimidate me.
I believe my boss is discriminating against me because I am a male. Every other employee at this location is female, except for one night shift worker, who is the father of the most favored asst. Manager.
I have witnessed on several occations the boss, and other female employees act differently to male and female customers. They are friendly and kind to the women, and cold to the men.
    So that's my story.
Am I being overly sensitive on this issue, or do I have an actual case of discrimination on my hands? And if so, what should I do?
    Thanks for your time,
    -E

    Welcome to the forum Electricity!
NO, you are not being sensitive to this crazy madness and style of intimidation. My questions are: 1) how long ago since you started working? has it been past the 90 days? In California you will be given 90 days to prove yourself.....after that either you stay or you are out the door. But, in your case you are purposely set out to fail instead of given support to improve. 2)what is your race?(i,e,African American, Asian, Hispanic etc.) these are under protected class. 3)tell us your age.
One thing for sure, fom my understanding you are the only male employee except for that older guy on night shift, and that is sexual discrimination. Contact the company HR which is usually where your check came from. Usually a convenient store is owned by a company/corporate office or it could be franchised. Either/Or, you should be able to call a 1-800 number for mistreatments and harassment issues. Keep us posted.....and hang tight! Others will be posting their peofessional/ expert/ moderators/ experienced advice.

    Welcome to the forum, Electricity.

I don't know that there is much you can do about any of this. OnYourSide *might* see something I don't, though. Its *obvious* that your boss is treating you differently than your female co-workers and they have not given you the hours you were promised or the pay you were promised when you were hired. That comment from a co-worker about the boss trying to make you quit because she "doesn't fire people" is ridiculous!! She must be a real nasty piece of work is all I can say.......

My guess is you're probably better off just looking for a job somewhere else that will appreciate you, Electricity. Sounds like this twit has her little "system" all figured out and you're not going to be able to fight it, I'm sorry to say. You don't have a contract with them, so there's really not much you can do about not getting the hours you were promised when you were hired. I'd find another job, then egg the place. (totally kidding about the egging!)
