    If you resign, you may not be eligible for unemployment benefits (unless you can talk the boss into laying you off). I am *glad" that making this decision is taking some of the pressure off of you, I just don't want it compiled with the possibility that you may not be eligible for UC.

    Never, never, NEVER threaten to resign unless you're prepared to leave THAT MOMENT. It's a sure bet that your boss is now scrambling to figure out how best to protect the company, now that he knows you're going to leave them high and dry. Not a good strategy on your part.

    What really bothers me about this unfair rules is the fact that we pay taxes each month, no buts about it/ no choice! California Gov. TERMINATOR is proposing to raise workers tax up to 10%!(shock) So with that being proposed the UC rule should also changed to give deserving ones who have been and will be paying this hefty taxes what they are/will be entitled to. Instead of handing it out free to the LAZY ones who keep drawing food stamps and giving birth each year so they can draw free money from state/gov. funds(no offense to anyone).........

    I totally agree with you, MsLiberated. I worked almost 25 years for the state of Washington and I am denied my UC due to the LIES and FABRICATIONS and INEFFICIENCY OF THE PHONE SYSTEM. I have been waiting 4 MONTHS for an appeal hearing. If that judge does NOT rule in my favor next Friday, I don't know what we are going to do.........

    Lulu i have a very good feeling about it.....you will get what you deserve. I remember when i went infront of the judge which was my final divorce proceedings with my first husband who accused me of everything he could think of that is nasty including being an unfit mother, and a hoar. ALL LIES,LIES, and more LIES!!!!!! I was stunned. But the Judge saw it all by just looking at my reactions. He was not interested on anything he accused me of. Just trust that you have done nothing wrong and that you are only fighting for what is YOURS! The judge will see through that. After all, that is why they are appointed to sit on that CHAIR to try to JUDGE fairly. Honestly in my opinion there is truly only one true judge and HE is UP There! HE will not let US.....you Lulu be tested beyond what you can bear.

    Thanks for your good thoughts MsLiberated. Curt keeps telling me not to worry because this is such an obvious case of retaliation & discrimination. He also keeps telling me the fact that I have an attorney and that the attorney will be representing me for the appeal hearing is a HUGE plus. My attorney also keeps telling me I *will* get my UC - BUT, after 4 months of me having no income to contribute to the household other than sales of my handcrafted items or selling personal items, I am getting pretty despondent and *scared*. We have NEVER not been able to pay our bills and have always had a bit of a reserve in savings. Right now we have not even got enough money in savings to pay our full 2nd half property taxes on Monday and I can't pay a personal loan payment on Tuesday. We have always had excellent credit and this is going to ruin our credit. We are 53 and 55 so we are probably not going to see that excellent credit rating come back for our retirement years. And all THANKS to an unethical ex-supervisor who LIED and FABRICATED evidence against me to get me fired so SHE did not get fired for breaking numerous ethics policies............

    I didn't threaten to quit. I was dead serious. I am tired.The games, the bullying. I wouldn't stay in a marriage this abusive. I have been given an overwhelming amount of work. I can't keep up, I work from home, trying to keep up. I'm constantly stressing out over all of it. I know that this is a way for them to kick me in the a##. Sometimes you have to pick your fight, and this one is a no winner. The drama queen and the other focus on one job. I handle their jobs when they are not there, and all of the other jobs they don't want to do for less pay. He is not scrambling to find someone else since there is a hiring freeze on and the owner will not be hiring. As far as anything goes, he will be laying off again.I just closed a $90M dollar deal for the company, the dept head congratulated me. I'm not going to see a payout like the rest in our department will. It will all be hush, hush, don't let Trisha know. The Manager and I had a good discussion and I'm pretty sure he was being a little sincere. He's the type that rather then talking would have said ok, if you want to go, leave. Whew.. you all have me scared... Why am I feeling guilty for saying I've had enough?

    No, he's NOT being sincere, he's just stringing you along until it's convenient for them to kick you to the curb. Sorry - get your head out of the sand.

    Trisha, I know you are tired of the games, the stress and the toll it is taking on your health. Just make sure that you really will be eligible for those unemployment benefits because you are going to need some form of income until you find another job. And jobs are so scarce right now.......I guess I am just worried that you might be trading one major form of stress for another.........

    On Your Side: My gut instinct is yours. He really is not being sincere. I more then likely will get kicked to the curb. My head is not in the sand. I just don't know what to do? How do I handle this? If I file for FMLA, I most definitely will be fired. I can't go to HR. I know quitting is a cop out. I know the economy is bad. Down deep, I am really afraid to take some type of action. I'm scared that it will effect my ability to get a position elsewhere. I know they will lie or do whatever it takes to maintain their innocence. HR and the Dept head are tight. They go for lunch together.The Manager is always hanging out at HR. Drama Queen is tight with the Manager. The other ones have their noses so far up their ###ts, since they are afraid they will be targeted also. There are people outside of our dept that will defend me. I have even been told that "that dept has always been that way" "and more then likely they will be the ones who will always be guaranteed their positions." How do you fight this and win? Why is this crap being allowed to happen in companies? Why is it the ones who work the hardest, attempt to get along with others get kicked the hardest? After going through all of this, I feel like there is something wrong with me. I took this position, motivated, willing to do whatever it took to succeed and now I literally feel sick every time I have to take that drive in to work.
    He didn't take my resignation letter, so more then likely once the drama queen returns from her surgery, they will be picking again and looking for reasons to run me off. I hope you understand why I said, either way ( meaning quitting or getting fired) really isn't going to make that much of a difference.

    There's not much you CAN do, Trisha - except wait for the hammer to drop - and unfortunately, it probably will as soon as they don't NEED you anymore. But you can be ready for it, and when it happens, you'll be entitled to collect Unemployment. If you quit, you'll have a VERY hard time getting Unemployment - so DON'T QUIT, no matter what. Make the bastards fire you.

    I'm desperately trying to hang in there. Tough today. The dept head is gone on vacation. The Manager is in charge. Drama queen decides she is just going to leave for the afternoon, no one knows that she is off. Anyway, the Manager is the King of micromanagement. Remeber I said all emails go through him first, he answers them and then dictates to us through email, ccing everyone, on what to do. Not only that but he has his admin going through our work and checking it. Well. today there was an issue. Instead of coming to us to ask us about it, she ran to him. Well, Mr drama manager, storms by my door, and saids in his condecending tone, into P's office, we need to talk, turns out I didn't log someone into our database because I was told the other worker wasn't to be added.(by her) This was a while back, I had done the documentation for her though and was putting it in the books. Miss admin says, I'm not trying to get anyone into trouble" I'm thinking yeah right.. Of course the other worker says, I did mine it's up to Trisha to do hers." When I confronted her and said " You were the one who said you weren't to be put in the database. "She said no I didn't" OMG.. I was pissed. I am so fed up with this stuff.

    Trisha this is when documenting everything comes very handy: dated, who, what where, why, and whom.....this is what HR's in my side of the war zone loathe about me. I asked for a copy of everything and I always end each conversation with " I have all this written in my journal of ##### would you like a copy of the details, I will be more than happy to bring you one" You see, you will be totally wasting your breath and strenght by getting pissed, you're passed that stage now!!! Don't let them see you overcome with emotions. Show them your best poker face. Make them think and believe you have no idea what they're up to........you'll see it's very therapeutic.

    Problem is, when you're doing your job, some things seem perfectly innocent; then they come back to bite you in the butt, hard! SO, you end up documenting every little miniscule thing, which then, in turn, makes your work flow suffer, so then you're kind of darned if you do and darned if you don't.

    I hear you whonme, but it's very impt. that we as victims of workplce violence learn to recognize that we need to be very vigilant. For example little papers where I write my schedule for the week which I usually discard when the week ends, now after all the crap I have to go through with management I kept every one of them(following my instinct) Guess what!?-the very same little pieces of paper save me from their attempt to write me up on attendane variance.......go figure! They just don't know how to stop.

    That is exactly why documenting everything, doing as much as you can by email so you have proof of what has transpired and keeping ALL verification in a safe place away from the job site is SOOO important because that is what is going to safe your butt.
