I tried reading the DOL regulations and I saw where it said everything about what was in that letter. What I'm a little confused about is tracking back to the alphabetical subparagraph, in order to understand the if's and why for's of the sections. I hope that makes sense.

Don't worry about it, kendred. You don't need to concern yourself with whether YOU'RE in compliance. YOU are. DCofBM is NOT, and he's now scrambling to try to figure out how he can continue to harass you without getting sued. If he's smart, as I said, he'll back off now.

Hello everyone
Today is another day for DCofBM to continue his onslaught.
He apologized for calling my doctor first but instead he calls this addendum to the form that was apporved NEW as of October 20 2009. This form was approved in April 2009.
1 He said my form was not valid for prior days I took off and if my condition has changed then I need a new certificate
2 My condition had not changed but it took him 6 months and instead of stating In Writing what additional information I needed he left me out in the cold to figure out what he wanted.
3. After turning in the same form with additional notations, he wants to consider it NEW, well is this a trick so he can come after me for the days he says were not covered previously.
4. I responded to his letter with the help of OnYourSide and Now he writes back wanting me to answer questions that should be self explanatory per the letter but that the FORM itself is tricky which indicates that days you take off are for doctor visits only, yet it says in the last sentence. " Include schedule of visits or treatment if they are medically necessary for the employee to be off work on an intermittent basis OR work less than employee's normal schedule of hours per day or days per week.Now I did read somewhere that I could be transferred to another department for being on intermittent FMLA and I wonder if he is trying to go that route. Confuse me he has but he is pi**ed per OYS and I believe her. He is not one for helping he is one for creating obstacles and confusion.

FMLA is NOT for doctors visits ONLY. It is for days or hours that pertain to your medical condition that the FMLA paperwork was written for. Your boss is a MAJOR ASS and is just trying to harass and retaliate against you for using FMLA which is ILLEGAL.

I thought at first he was going to send me out for a second opinion, which I would have been the first person he has done that to. So many people are on FMLA and over 50% in just my department alone he is pi**ed to the highest but he was caught with his pants down with that letter and he backed down a little. I'm just wondering if he will start this all over again once I call off using my FMLA? He calls this additional information on the approved form NEW certification. There is a top copy that I fill out, should I submitt another one for him to sign since this is a NEW cert that would cover me until Oct now instead of April?Posted 3 weeks ago # -

No, kendred, I'd just leave it alone until April, then have your doctor fill out a whole new one in April for another year's worth.

Kendred, isn't that the truth??? I *learned* some really choice words and phrases when I worked at the mill where it was 95% guys and 5% women. And they say WOMEN are gossips. MEN are WAY WORSE (LOL).

And as far as DCofBM being pi**ed about half the department being on FMLA - maybe it has something to do with his attitude and causing so much stress around there that people feel they can't deal with him? And if he doesn't like the LAW, he should cry to his Congressperson, not take it out on the employees who are following the law.

It's this attitude flowing throughout the department. I have been trying to find a way to answer his letter, as I read it, it's like he wants to trap me into saying something that he will come back later and use against me. Why would he ask me questions like this if for no other reason when the FORM is the problem. Is there a time limit on this clarification as well?

Ah, okay, I see. YOU didn't upset me, don't worry. If he didn't give you anything in writing, I don't see that you have any time limit on responding to him.
But - I recommend that you tell him that if they used the REAL form that the Department of Labor recommends instead of that BASS-ACKWARD one some dipwad-on-drugs came up with, it would certainly make it simpler for everyone involved. I'll email you the new DOL form. Print that out, give it to DCofBM, and point out where the information goes. And THEN tell him to take the form, roll it up real tight, and put it where the sun doesn't shine ...

Update so far, thank you OnYourSide for helping me and I got my response although it was verbal but my FMLA papers are good to go.....:)
Second thing, Major investigation is about to occur stemming from my Lead who was also moved to days who by the way has emailed the directors from public safety to personnel and the Mayor regarding this supervisor, DcofBM and the manager. I don't trust this because this is not the first investigation, that was left up to the Chief to handle by the way and nothing was ever done.
I found out today that DCofBM is retiring and who takes his spot will probably be just as incapable, but who knows, good things have been known to happen from situations like this. But as for supervisor well complaints have been pouring in on her from everywhere within this department field and administration employee's.Posted 2 weeks ago # -

Well thank you all for the support,
I hope everyone is right about having a boss thats not into all that nonsense but your right OnYourSide thanks to you, a lot of stress has been lifted off my shoulders now that DCofBM has finally left me alone on this(FMLA)issue. But I'm sure this is not the end, HE will come after me for something else, I just hope it won't be too soon at least I'm keeping the FAITH as msliberated said.

Hello everyone
I hope you all are doing well.
Update on so far, I'm going back to the night shift as of Dec 6 2009 and I'm happy about that, I won't be going back to my original side on nights but it's nights all the same.
I will be under a different lead who is also new and per others I work with, she is not the best person to work under although in her mind she thinks she is and I wont be the one to change her mind. I'm just glad to get back to my normal life.All this happened after I went to the ADA department and explained my situation. Although they told me they don't have the authority to enforce, they did speak with DCofBM. I was wondering why he was looking at me so funny and now I know. OnYourSide helped me with a letter requesting accommodation and I didn't get a chance to submit it before my supervisor requested to speak to me in her office (shocked) and said my scores improved tremendously (shocked again)and that I can go back to nights but not the night shift I came from. I will be going on nights on the side I am on now which means someone on nights will be bumped. I am on the promotional list for lead and at this point I don't want the position of being stressed out like this and only getting a 5% raise for it, I am glad to be away from the drama of being on days and I'm sure my stress level will decrease as well.

lulu although I could see in her face that my going to nights was not her idea, she gave me a warning " don't go back to night and your score begin to go down" which means any time I want, I can say your scores are low and you can be moved back to days. shaking my head at the power trip she is on and how close she is to becoming a memory herself if she keeps on this path of messing with people.Thank you msliberated also
I'm sure this is not the end of her messing with me at the orders of higher management so I'll just do my job to the best of my ability and pray they leave me alone. I'm glad in a way to have had this experience (minus the stress) these lessons have made me a stronger person when dealing with bad bosses. As the old saying goes, it's not the size of the dog in the fight that wins but the size of the fight in the dog.Thank you all for your support, insight and knowledge
